Scope and Content Note

 

Gathering together items obtained from various sources, the Land Patent Collection consists of the certificates issued by the Texas government, granting specific tracts of land under various land grant processes.

 

Under the system established by the Republic of Texas, the General Land Office was created to oversee the management of public lands, opening in 1838.  Headright grants, the designation of first, second, third or fourth class indicating the date of arrival in Texas, granted land to settlers who established residence prior to 1842.  The amount of land granted depended upon the class of the grant, and whether the grantee was the head of a household or single.

 

Donation certificates granted land to individuals or their heirs who served in various battles and campaigns during the Texas Revolution.  Bounty warrants granted land for service in the army of the Republic of Texas.

 

Various other types of grants were issued during the 19th century, such as pre-emption, or homestead grants, grants to indigent veterans of the Texas Revolution and Civil War, and grants for internal improvements, such as railroads.

 

Obtaining title to the land involved several steps.  If the petition for a grant was approved, vacant land was located, its availability proven, and a survey done.  The issuance of a patent, the legal transfer of the title to the patentee, was the final step in the process.  Patents include a legal description of the land, and are signed by the President of the Republic or the state Governor, and the Commissioner of the General Land Office.

 

The items in the Land Patent Collection are arranged alphabetically, by the name of the patentee.  The description of each item in this inventory includes the name of the patentee; the original grantee, if the grant was legally assigned to another; the number of the patent; the type of grant, if indicated on the certificate; acreage; location; the President or Governor who signed the certificate; and the date of issuance.  If the item is a certified copy of the original certificate, the date the copy was issued is also given.  If the item is part of a larger collection of papers, its source is indicated.  Some items in the collection are photocopies.

 

A second listing of the patents, showing the chronological order of issuance is found at the end of the inventory.  This list includes the name of patentee, and the date of issue.

 

Also included in the collection are two land grant certificates from the state of Tennessee, dating from the governorship of Sam Houston, and bearing Houston's signature.
